Peoria Temporarily Relaxes Outdoor Patio Restrictions

The city makes it easier for local businesses to expand outdoor capacity.
PEORIA, Ariz. (Nov. 12, 2020) – In an effort to continue to look for ways to help the local business community in the midst of a global pandemic, the Peoria City Council approved a temporary provision enabling restaurants and bars in Peoria to expand outdoor seating patios. 

“Small businesses have encountered many disruptions over the past year and it’s critical that we continue to do all that we can to support them,” said Mayor Cathy Carlat. “This provision is about easing restrictions to help our local restaurants and bars maximize their offerings to our community. It’s just in time for cooler weather and I hope our businesses take advantage of this opportunity to expand their footprint.”

This provision, named the Temporary Use Permit – Extension of Premise (TUP-EP), will be effective immediately and will be administered by the Peoria Planning and Zoning Department in consultation with other city departments. The process is designed to quickly enable restaurants and bars, impacted by the COVID-19 global pandemic, to safely relocate some of their lost indoor dining capacity to an outdoor location. The new patio or expansion will be limited to 50% of the current occupant load of the establishment. The TUP-EP will align with the mayor’s proclamation declaring a state of local emergency. At the expiration of the emergency, those establishments using the special TUP-EP will have up to 60 days to restore the premises to its prior approved configuration or seek permanent approval of the expanded outdoor patio area.

There is no fee for a TUP-EP and the review is intended to verify that the expansion does not create any safety or access issues such as blocking ingress or egress, fire lanes, sidewalks, ADA access and parking.
